Market surviellance is carried out by HSENI to ensure products which are being used / manufactured within our market places are compliant to the legislation and safe for use.

The Product Safety Team focus on legislation concerned with the design, manufacture and supply of new products, including:

  1. Designing and building for safety
  2. Assessing product conformity
  3. Demonstrating product compliance
  4. Providing users with relevant information

Most new products come within the scope of one or more regulations and Directives, all have a common requirement for Conformity marking. However, some work equipment that is not powered or used to lift - such as hand tools, racking and ladders - does not come within the scope of these regulations and must not be Conformity marked.

Instead these products must meet section 6 of the Health and Safety at Work etc. Act 1974. The legislation can be found at the following link:

  • Health and Safety at Work etc. Act 1974 - (legislation.gov.uk)

Who needs to comply with the legislation?
