This consultative document sets out a proposed amendment to extend the exemption provided in Article 13 of the Employment (Miscellaneous Provisions) (Northern Ireland) Order 1990 - for turban wearing Sikhs on construction sites - to cover all workplaces where a risk assessment requires workers to wear head protection.

The proposed amendment will address an anomaly in the law whereby currently, turban wearing Sikhs are exempt from wearing head protection in one of the most hazardous industries, construction, but may be required to wear it in lower risk workplaces.  

The amendment will also extend the limited liability provisions of that exemption to their employers.
