Proposals for Amendments to the Personal Protective Equipment at Work Regulations (Northern Ireland) 1993

Summary

The consultation seeks views on proposals by HSENI on amendments to the Personal Protective Equipment at Work Regulations (Northern Ireland) 1993 (S.R. 1993 No. 20) (PPER). The PPER place a duty on every employer in Northern Ireland to ensure that suitable personal protective equipment (PPE) is provided to employees who may be exposed to a risk to their health or safety while at work. Currently, employers only have a duty to their ‘employees’ in respect to PPE – changes to the legislation will ensure this duty also extends to ‘limb (b) workers’.

Consultation description

The proposals substitute a new interpretation provision, including a new definition of worker. The proposals also modify the application of Article 10 of the Health and Safety at Work (Northern Ireland) Order 1978 with regards to PPER. Article 10 places a general duty on employers not to charge employees for things done in pursuance of specific requirements of the relevant statutory provisions.
